TERMS OF SERVICE

1. Description of Service

DKB Creative uses artificial intelligence to generate promotional flyer images from a photo you upload and event details you provide, for use by fitness instructors and studios in marketing their classes and events.

2. Eligibility & Accounts

You must be at least 18 years old to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Subscriptions, Billing & Cancellation

• Paid plans are billed in advance on a monthly cycle via our payment processor, Stripe.
• Your subscription renews automatically each billing period unless you cancel.
• You may cancel at any time from your Account page. Cancellation takes effect at the end of your current billing period, and you retain access until then.
• Fees already paid are non-refundable, except where required by applicable law.
• We may change subscription pricing going forward; we'll make reasonable efforts to notify active subscribers in advance.

4. Your Content & Photo License

• You retain ownership of any photo you upload and of the flyers generated from it.
• By uploading a photo, you confirm that you own it or otherwise have the right to use it, and that it depicts you or someone who has given you permission to use their likeness for this purpose.
• You grant DKB Creative a limited license to process your uploaded photo and event details solely to generate flyers on your behalf, and to retain your generation history so you can access it later from your account.
• You are solely responsible for the accuracy of the event details (dates, prices, locations, contact info) you enter.

5. AI-Generated Content

Flyer images are produced using third-party AI image-generation technology. Output can vary between generations and is not guaranteed to reproduce your uploaded photo identically in every detail. You're responsible for reviewing each generated flyer before you publish or distribute it.

6. Acceptable Use

You agree not to use the Service to: upload a photo of another person without their consent; create misleading, fraudulent, or unlawful advertising; infringe anyone's intellectual property or trademark rights; or attempt to disrupt, reverse-engineer, or abuse the Service.

7. DKB FIT® Trademark

"DKB FIT" and its associated marks are registered trademarks. Branding elements referencing DKB FIT within generated flyers are provided for use by DKB FIT-affiliated instructors in the ordinary course of promoting DKB FIT classes and events, and this does not grant any broader license to the DKB FIT trademark.

8. Intellectual Property

The DKB Creative software, design, and underlying technology belong to DKB Creative and its licensors. Nothing in these Terms grants you rights to our software or brand beyond your right to use the Service as intended.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We don't guarantee the Service will be uninterrupted or error-free.

10. Limitation of Liability

To the fullest extent permitted by law, DKB Creative will not be liable for indirect, incidental, or consequential damages arising from your use of the Service.

11. Termination

We may suspend or terminate accounts that violate these Terms.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect means you accept the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions.
